The validity of our price lists is subject to periodical updating, integration or substitution of the present technical sheets that will periodically be sent via e-mail and published in the reserved area of the SIR VISUAL website.
The prices published in the price list do not include VAT and are subject to change at any time without any obligation of notice from Sir Visual. In addition to the specific sales conditions for each product, the following is also valid:
Warranty and Liability
Our company guarantees that the products distributed by us conform to the specifications reported on the packaging and on the technical sheets issued by the producers. SIR Visual’s liability for non-conforming products is exclusively limited to the replacement of the product. SIR Visual will not replace any products or be liable for damages incurred by the purchaser due to improper storage, use or sale of the product if our instructions are not complied with.
Fitness for a Particular Purpose
The purchaser must be aware of the intended use of the product and therefore must assume any risk and responsibility of the use of the product.
Information and Assistance
Upon the purchaser’s request SIR Visual will provide any useful information to the best of their ability in order to improve the use of the materials and equipment.
Sizes and Images
The data included in published information has been reported to the best of our knowledge, however such information may not be considered binding and does not relieve the client from any responsibility of performing their own check before proceeding to the manufacturing of the product.
Transport and Claims
The purchaser is responsible for any risks and costs incurred by the transport of the product(s). Upon delivery by the forwarder it is important to see and count the packages and, in case the external packaging or goods are found damaged, to sign the consignment documents reserving to further check the goods at a later time. In such case the damage must be specified in writing in the consignment note. If transport is provided by SIR Visual (carriage paid with charges agreed upon with our Sales Office) the merchandise shall be delivered free on board the truck and the unloading of the truck will then be the responsibility of the purchaser. If the purchaser is responsible for the transport (carriage forward), it must be specified that SIR Visual takes no responsibility and therefore any dispute must be resolved directly with the forwarder. Claims for defective goods or goods sold in free port must be communicated to SIR Visual through the appropriate form posted on the homepage of the reserved area of the company’s website, which dictates the time and way the form must be filed. Goods damaged during transport must be communicated within 8 days from the date of delivery (the date found on the transport document). Claims for defective goods filed six months from the date of delivery will not be accepted.
Retiring Goods
Returned goods must be authorized by SIR Visual ahead of time. The shipment of the goods must be paid by the purchaser and consequently will be shipped at the risk of the client. In no case will tampered, damaged or improperly used products be accepted.
Conditions of Payment
Upon filling the client’s first order, the goods must be countermarked. Subsequent orders must be agreed upon with the Sales Office of SIR Visual.
Outstanding and Late Payment
Payments must be made to SIR Visual according to priorly made agreements. Interest will be applied to each late payment. SIR Visual reserves the right to stop any order in the case of outstanding payments.
Place of Jurisdiction
In the case of any dispute among parties the lawful place of jurisdiction is Brescia.
